Terms & Conditions

These Terms and Conditions govern all transactions, accounts, and interactions with Parts Donga through our website and any other sales channel. By placing an order, creating an account, or using our website, you agree to be bound by these Terms. References to “Parts Donga”, “we”, “our”, and “us” mean SACT Group Pty Ltd (ABN 86 689 706 787), Brisbane, Queensland, Australia.

1. Accounts & Registration

Where a customer account is registered, you are responsible for maintaining the accuracy of your information, keeping your credentials secure, and all activity that occurs under your account. We reserve the right to suspend or terminate accounts where these Terms are breached or where fraudulent activity is suspected.

2. Quotes

Quotes are valid for 14 days from the date of issue unless otherwise stated. Prices may change without notice due to supplier cost movements, exchange rate fluctuations, or manufacturer changes. Acceptance of a quote does not form a binding contract until we issue a confirmed invoice. We reserve the right to withdraw or revise a quote at any time prior to invoicing.

3. Orders & Contract Formation

An order placed through our website or otherwise constitutes an offer to purchase. A binding contract is formed only when we accept your order and issue a confirmed invoice or dispatch confirmation. We reserve the right to refuse or cancel any order at our discretion, including where a product is unavailable, a pricing error has occurred, payment cannot be verified, or the order appears fraudulent. Where an order is cancelled after payment, a full refund will be issued.

4. Pricing, GST & Currency

All prices are in Australian Dollars and exclude GST unless otherwise stated. GST is applied at checkout as required by law and a tax invoice will be issued. For international orders, currency conversion fees are the responsibility of the customer. We reserve the right to correct pricing errors prior to dispatch. Promotional pricing applies only for the stated period and cannot be applied retrospectively.

5. Payment

We accept payment by credit and debit card, PayPal, bank transfer (EFT), and buy-now-pay-later services where available. Payment is required in full at checkout unless a credit account has been approved. Credit account customers are subject to strictly 30-day terms from invoice date. EFT orders will not be dispatched until funds have cleared. A surcharge may apply to certain payment methods and will be disclosed at the time of payment. Interest may be charged on overdue balances at 2% per month calculated daily. We may suspend supply where payment obligations are not met. Where buy-now-pay-later services are used, the terms of that provider also apply.

6. Delivery & Shipping

We supply to Australia and select international destinations including New Zealand, Papua New Guinea, Fiji, Samoa, Vanuatu, and other Pacific nations. All dispatch and delivery timeframes are estimates only. Delays do not entitle you to cancel an order or withhold payment. Risk passes to you on delivery or collection by your freight carrier. Where we arrange freight, risk passes when goods are handed to the nominated carrier and we are not liable for loss, damage, or delay in transit. Transit insurance is available at your cost upon written request prior to dispatch. For international orders, all import duties, taxes, customs clearance, and compliance with local laws are the responsibility of the customer. Shipping costs are non-refundable except where required by law.

7. Title & Retention of Title

Ownership of goods remains with Parts Donga until payment in full has been received. Until paid, goods must be stored separately, clearly identified as our property, and must not be on-sold or encumbered. We may register our security interest on the Personal Property Securities Register (PPSR) and you agree to do all things reasonably required to facilitate that registration. Risk passes to you on delivery regardless of when title transfers.

8. Returns & Refunds

Returns are subject to our Refund and Returns Policy. A Return Authorisation must be obtained prior to returning any goods. A restocking fee of up to 20% may apply. Special-order, electrical, and customised goods are not returnable except where required by law. Credits issued are applied to your account and are not redeemable for cash unless required by law. Nothing in this clause affects your rights under the Australian Consumer Law.

9. Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Where goods are not ordinarily acquired for personal, domestic, or household use, our liability is limited — at our option — to repair, replacement, or refund of the purchase price. No additional warranties are provided beyond those required by law unless confirmed in writing.

10. Fitment & Technical Information

Correct fitment depends on accurate vehicle or equipment information being provided at the time of ordering. The customer is responsible for providing correct details, verifying compatibility, and ensuring appropriate installation. Parts Donga is not liable for labour, diagnostics, downtime, or consequential loss arising from incorrect part selection, inaccurate information provided by the customer, or improper installation, except as required by law.

11. Loyalty Program & Store Credit

Where a loyalty program or store credit is offered, points and credits hold no cash value, are non-transferable, and are linked to the registered account. We reserve the right to modify, suspend, or discontinue any loyalty program at any time. Credits or points obtained fraudulently may be cancelled without notice. Specific terms for any active program will be published on our website.

12. Core / Exchange Units

Where products are supplied on a core/exchange basis, a refundable core deposit applies. Cores must be returned within 30 days of invoice date — complete, clean, drained of fluids, and in rebuildable condition. Non-serviceable, incomplete, or late returns may result in a reduced or forfeited deposit and may attract surcharges.

13. OEM Independence

Parts Donga is an independent supplier and is not an authorised dealer, distributor, or agent of any original equipment manufacturer. OEM brand names, trademarks, part numbers, and descriptions are used for reference and identification purposes only and do not imply any affiliation with or endorsement by the relevant manufacturer.

14. Intellectual Property

All content on the Parts Donga website including text, images, logos, product descriptions, and design is owned by or licensed to SACT Group Pty Ltd. Reproduction, distribution, or use of any content without prior written permission is prohibited.

15. Website Use & Accuracy

We take care to ensure product information, pricing, and availability is accurate but errors may occur. We reserve the right to correct errors at any time. We do not warrant that the website will be available without interruption or free from errors. Use of the website is at your own risk.

16. Limitation of Liability

To the maximum extent permitted by law, Parts Donga excludes all liability for indirect, incidental, special, or consequential loss or damage including loss of profit, revenue, production, or opportunity. Where liability cannot be excluded, our total liability is limited to the amount paid for the relevant goods or services. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

17. Force Majeure

We are not liable for any delay or failure to perform obligations caused by events beyond our reasonable control including natural disasters, pandemics, industrial action, government restrictions, supply chain disruptions, or cyber incidents. Performance obligations are extended for the duration of such events.

18. General

We may offset amounts owed to us against amounts we owe you. We may assign our rights at any time; you may not assign yours without our written consent. If any provision is found invalid, the remainder continues in full force. Failure to enforce any provision is not a waiver of that provision. Notices may be given electronically. These Terms may be updated from time to time and the current version will always be available on our website.

19. Governing Law

These Terms are governed by the laws of Queensland, Australia and the Australian Consumer Law where applicable. You submit to the non-exclusive jurisdiction of the courts of Queensland. For international customers, compliance with local laws is your responsibility.
